To Whom It May Concern:

My wife and I enjoyed our stay at the Vidanta Resort in Nueva Vallarta in 2016. The grounds were beautiful, and the service was excellent. We did attend a sales presentation, and purchased a time share that we felt we could use and could afford. We were very happy.

In January, 2018, we returned to Vidanta, this time in the Riviera Maya, and again attended a sales presentation. The salesman, Alex Bailey, kept us for over EIGHT HOURS, showing us the groundwork for the Lazy River, the planned luxurious estates, and pictures of the new resort under construction in Los Cabos, complete with the largest salt water pool in the world.

He kept telling us that we were not managing our timeshare properly, and that under his tutelage and the contracts he proposed, we could be making nearly $100,000 every year! He had contacts to whom he would introduce us who would rent our new estate for us for a small fee. But why pay them, he asked, when he could show us how to create our own website, and rent it ourselves?

After eight hours of fantasies, our heads were spinning. We should have excused ourselves at this point, but instead we allowed exhaustion and greed to cloud our judgement, and we did sign for both contracts. Immediately we felt remorse, but had not been told that there was a five day cooling off period allowed to rescind the contract.

After we left the resort we did reach the two contacts Alex had given us. The first lady said sure, she could rent out villa out. But only at Christmas and only for $4000, not the $40,000 that Alex had promised! The other contact had not yet set up a website, but promised to let us know when it was available. Our subsequent calls to him went unanswered. Alex suggested we create our own website, but never provided the promised assistance. As far as the promises made about the resort development, well, the Park has lost its partnership, and much of its lustre, with Cirque du Soleil. The original developer is now mired in scandal, and the construction is far from complete. As a result all of the other Vidanta projects are suffering as well. The Lazy River is incomplete, a new building at the Acapulco resort remains an empty shell, and ground has not been broken at the new Los Cabos resort. The current Los Cabos resort has adopted a nightclub atmosphere, suitable only for people in their 20's and 30's. So much for the impetus for investment!

When we realized how badly we were scammed by Alex Bailey, we reached out to Vidanta Customer Service. Nicholas Steele, realizing the misrepresentations that were made to us, did help us to change those contracts, but those changes did not resolve our problems. We have spent a lot of our retirement income on an investment that doesn't really exist. Since that time, we have held several discussions with Customer Service at Vidanta, but we have been shuffled around from one department to the next, even though they all realize that the issues arose in Cancun. We did spend another six hour discussion with the sales team in Acapulco, and did reach an agreement, shook hands on it, but then they denied the agreement and tried to convince us to purchase even more! In the meantime rogue salespeople like Alex Bailey have remained free to scam others with lies and false promises.

We want to return to our original contract, before lies and misrepresentation led us far off our path. We understand that Vidanta could easily make this happen, and ask that they do so.
